A property owner living in an exclusive housing estate located on the outskirts of Hartlepool is facing potential enforcement action, after Hartlepool Borough Council refused retrospective planning permission for a boundary wall which was installed without prior council approval.


HBC Exposed understands the boundary wall—constructed around the perimeter of the property—required council approval under local planning regulations before it could be built. However, rather than applying in advance, the owners reportedly proceeded with construction and only submitting a retrospective application for the work in January this year.


That application reportedly drew significant concern from both residents and Wynyard Parish Council, where It’s claimed the wall was constructed outside of the permitted planning regulations for the housing estate, which is reportedly subject to stricter controls in keeping with the area's distinct character and layout.


Following a review, its said that Hartlepool Borough Council sided with the objectors concerns and rejected the application outright, concluding the boundary wall did not comply with the area’s planning policies.


Sources have indicated the homeowners have since been informed that unless the wall is removed voluntarily, the council is set to undertake formal enforcement proceedings compelling the homeowners to dismantle it, this was confirmed after HBC Exposed was passed an officer delegated decision record stating that the councils Director of Regenerations Tony Hanson had signed off on Enforcement to take place, with failure to comply with the notice potentially resulting in prosecution or a significant financial penalty.


The case is said to serve as a warning to other property owners—particularly in areas like Wynyard, where planning rules are tightly enforced—that bypassing planning procedures is likely to land you in 'hot water', even if permission is sought after the fact, with council planning officers across numerous local councils always telling local residents that if in doubt..... consult a licenced reputable planning agent before commencing any works as failure to do so could become a costly venture.
