HMO Conversion Work Underway as Owner Seeks Lawful Development Certificate

A Hartlepool property owned by a London Based Property Developer could be converted into a five-bedroom house in multiple occupation after an application was submitted to Hartlepool Borough Council.
The application for 22 Kilwick Street in Hartlepool seeks a Lawful Development Certificate for a proposed change of use from a residential dwellinghouse, known as a C3 use, into a five-bedroom house in multiple occupation, commonly referred to as an HMO.
According to the documents, the proposal would involve internal alterations to the existing property, with the application form also stating the proposed development are already underway.
The applicant argues that the conversion meets the requirements of permitted development and that there are no active Article 4 restrictions preventing the property from being changed from a standard family home into a HMO.
Article 4 directions can be used by a local council to remove certain permitted-development rights in a designated area. Where no such restriction applies, some smaller HMO conversions may be able to proceed without a conventional planning application, although a property owner may still apply for a Lawful Development Certificate to obtain formal confirmation that the proposed use is lawful.
The application comes as Hartlepool Borough Council moves towards introducing tighter controls on the conversion of family homes into houses in multiple occupation. Under the council’s proposed Article 4 Direction, property owners would no longer be able to rely automatically on permitted-development rights when changing a standard dwellinghouse into a smaller HMO for between three and six residents. Instead, future conversions of this kind could require a planning application to be submitted and considered by the council.
The proposed restrictions are not yet in force, but the local council has said that, if the Direction is formally confirmed, it's expected to take effect from December 1st, 2026. A separate but similar proposal is being progressed for the part of the town covered by Hartlepool Development Corporation.
A final decision on the current plans for the property in Kilwick Street will be made by Hartlepool Borough Council after the application has been assessed.
